In the Firing Line?

The Information Commissioner’s Office has launched ICO 25, its new draft strategic plan for the period 2022-25.

The plan is currently open for consultation until 22 September 2022.

Among other things, the plan sets out the intended focus of the Commissioner’s investigations and enforcement activity in relation to data protection and the processing of personal data under the UK GDPR, Data Protection Act 2018 and Privacy and Electronic Communications Regulations (PECR), and also has an eye to the forthcoming Data Reform Bill.

We identify below the 15 industry sectors and activities singled out for particular attention:

  1. Recruitment, and in particular the use of algorithms for sifting applications

  2. Banking and finance, in relation to the collection of data for, and use of, intelligence databases

  3. Law enforcement, particularly in relation to the use of victims’ personal data and processing of personal data for safeguarding

  4. Gambling, generally and specifically in connection with the use of targeted advertising and adtech and their impact on vulnerable individuals

  5. Care sector, particularly in connection with the use of CCTV

  6. Health

  7. Public sector

  8. Biometric technologies, and in particular any adverse impact of such technologies on vulnerable groups

  9. Online tracking and third party cookies

  10. Benefit system, in particular the use of algorithms within the sector and their impact on vulnerable individuals

  11. Sites and platforms likely to be used by children, including social media platforms, video and music streaming sites and gaming platforms

  12. Digital service providers and systems, specifically in connection with product security

  13. AI & algorithms

  14. Predatory marketing, scams and frauds

  15. CCTV

Organisations in these sectors or engaged in these activities may wish to consider conducting a self-audit to ensure that they have all appropriate documentation in place and have implemented safeguards according to the risks presented by processing activities.
