On Hand August 2024
Those hoping for a quiet August to rest and regather were cruelly denied with regulators in the UK and across Europe continuing to issue decisions and consultations apace. With the new Labour government likely to seek to make a pronounced impact in their first 100 days, the pace of developments is expected to increase as new legislation is introduced and regulators take steps to implement the major legislation introduced under the previous Conservative government. We’re bracing ourselves as the new school year gets underway.
Important updates in August 2024 to be aware of included:
Information Commissioner’s Office (ICO) publishes notice of intention to fine data processor over £6m after ransomware incident affecting NHS;
Dutch data protection authority, Autoriteit Persoonsgegevens, fines Uber €290m over EEA-US transfer of driver data in the absence of safeguards, which Uber indicates it will appeal;
Provisions of the Media Act 2024 come into force with effect from 23 August 2024;
ICO issues 5th Generative AI call for evidence on the allocation of controllership across the generative AI supply chain;
Competition & Markets Authority (CMA) accepts proposals to vary Meta’s commitments on use of advertising customers’ data;
ICO issues call for evidence on Children’s Code and warns 11 social media companies and VSPs to improve compliance;
Brazilian data protection authority, ANPD, approves regulation on international data transfers;
UNESCO consults on regulatory approaches for AI;
Call for Institute of Directors to revise voluntary Code of Conduct for Directors to recognise risk management & resilience as part of responsible business;
Telegram CEO Pavel Durov arrested by French authorities over alleged failures to curb criminal activity on the messaging app and use of encryption;
UK government to bring forward legislation for Financial Conduct Authority (FCA) to regulate ESG ratings industry;
Irish Data Protection Commission welcomes Twitter/X suspension of personal data processing to train its 'Grok' AI after injunction application;
Press Recognition Panel publishes report on Press Intrusion and Regulation and calls for Leveson compliant press self-regulation;
Data protection fees paid to Information Commissioner by data controllers set to increase;
Ofcom consults on amending draft Online Safety Act 2023 illegal harms codes of practice & guidance to tackle animal cruelty & human torture;
Bristol City Council appeals ICO Enforcement Notice issued for continuing non-compliance with s.1(1) & 10(1) FOIA 2000;
CMA closes Google & Apple investigations under Competition Act 1998 to focus on powers available under Digital Markets, Competition & Consumers Act.
